Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the TriageKit website, the TriageKit macOS application, and related services (together, the “Service”), provided by TriageKit (“TriageKit”, “we”, “us”). By using the Service you agree to these Terms. If you use the Service for an organization, you confirm you have authority to bind that organization.
1. Early access
The Service is currently in early access. Features may change, be removed, or be unavailable, and the Service may contain errors. We may limit, suspend or end early access participation at any time. Early access terms, including pricing, will be communicated before any charges apply.
2. Your account
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account and for your team members’ use of the Service. Tell us promptly at founder@triagekit.space if you suspect unauthorized use.
3. License
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the TriageKit app on devices you own or control for your internal software development. You may not copy, modify, reverse engineer, sublicense, resell or distribute the Service except as permitted by law or in writing by us.
4. Your AI provider and third-party services
TriageKit requires you to supply your own AI access: either an API key from an AI provider, or a local AI model running on your own computer. Your use of a provider’s API is governed by your agreement with that provider, and the provider bills you directly. You are responsible for the usage, cost and compliance of requests made with your key. TriageKit does not integrate directly with third-party AI coding tools; if you share a TriageKit report with such a tool, your use of that tool is governed by its own terms. TriageKit also depends on Apple developer tools such as Xcode and the iOS Simulator, and on tools such as Metro; their availability and terms are outside our control.
5. Your content and code
You keep all rights in your source code, screenshots, designs and other materials (“Your Content”). You give us only the limited permissions needed to operate the features you use, such as storing synced history if you enable cloud features. You are responsible for having the right to use Your Content with the Service, including sending it to the AI provider you choose.
6. AI-generated output
TriageKit uses AI models to analyze screens and propose code changes. Output may be incorrect, incomplete or unsuitable for your project. TriageKit shows patches for your approval; you are responsible for reviewing, testing and deciding whether to apply any change, and for the results of applying it. Do not rely on the Service as your only quality assurance.
7. Acceptable use
You agree not to: use the Service unlawfully or to infringe others’ rights; attempt to disrupt, probe or gain unauthorized access to the Service; circumvent usage limits or license restrictions; use the Service to develop software that violates applicable law; or send content you do not have the right to process.
8. Fees and billing
Paid plans are billed in advance in US dollars, per plan or per seat as shown on the Pricing page, and renew monthly until cancelled. Prices exclude taxes unless stated. You can cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law or stated otherwise in writing. We may change prices on reasonable notice, and changes apply from the next billing period.
9. Intellectual property
The Service, including its software, design and documentation, is owned by TriageKit and its licensors and is protected by intellectual property laws. If you send us feedback, you allow us to use it without restriction or obligation to you.
10. Non-affiliation
TriageKit is an independent product. It is not affiliated with, endorsed by, or sponsored by Anthropic, OpenAI, Google or Apple. “Claude” and “Anthropic” are trademarks of Anthropic, PBC; “OpenAI” and “Codex” are trademarks of OpenAI; “Gemini” and “Google” are trademarks of Google LLC. Other names are trademarks of their respective owners.
11. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted, error-free or secure. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, TriageKit will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose, or US $100 if you have not paid us.
13. Indemnification
You will defend and indemnify TriageKit against third-party claims arising from Your Content, your use of the Service in breach of these Terms, or your violation of law, to the extent permitted by applicable law.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive, including sections 5, 9, 10, 11, 12, 13 and 15.
15. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which TriageKit is established, without regard to conflict-of-laws rules. The courts of that jurisdiction have exclusive jurisdiction over disputes, except where applicable law gives you the right to bring claims elsewhere.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and change the date above. If you keep using the Service after changes take effect, you accept the updated Terms.
